{"id":3906,"date":"2024-08-30T15:21:06","date_gmt":"2024-08-30T19:21:06","guid":{"rendered":"https:\/\/www.restaurantscanada.org\/?p=3906"},"modified":"2024-08-30T15:21:10","modified_gmt":"2024-08-30T19:21:10","slug":"changes-to-the-temporary-foreign-workers-program-faqs","status":"publish","type":"post","link":"https:\/\/www.restaurantscanada.org\/fr\/changes-to-the-temporary-foreign-workers-program-faqs\/","title":{"rendered":"Changes to the Temporary Foreign Workers Program &#8211; FAQs"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><em>An important update from Maximilien Roy, Vice-President Federal &amp; Qu\u00e9bec, Restaurants Canada<\/em><\/h3>\n\n\n\n<p><strong>Am I affected by these new measures?<\/strong><br>Yes, if you are in the foodservice industry and utilize the Temporary Foreign Workers (TFW) program, you will be affected by the following two measures:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Workforce Cap:<\/strong> TFWs can constitute no more than 10% of your total workforce.<\/li>\n\n\n\n<li><strong>Reduced Employment Duration:<\/strong> The maximum employment period for a TFW has been shortened from 2 years to 1 year.<\/li>\n<\/ol>\n\n\n\n<p>Additionally, if your business operates in a census metropolitan area where the unemployment rate is 6% or higher, the Government of Canada will not process your Labour Market Impact Assessments (LMIAs).<\/p>\n\n\n\n<p><strong>New Information:<\/strong><\/p>\n\n\n\n<p>Restaurants Canada has been on multiple calls with government officials to determine what these changes mean immediately and following the implementation date of <strong>September 26<\/strong>. The information is slow in coming.<\/p>\n\n\n\n<p>The following are responses we have received to common questions from operators. The information may change but it is currently the most accurate.<\/p>\n\n\n\n<p><strong>How can I determine if I am in a Census Metropolitan Area with a 6% or higher unemployment rate?<\/strong><br>You can verify this information <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/daily-quotidien\/240510\/t007a-eng.htm\">here<\/a>.<\/p>\n\n\n\n<p><strong>Do these measures apply to international students?<\/strong><br>No, these measures only apply to temporary foreign workers hired through an LMIA.<\/p>\n\n\n\n<p><strong>I submitted LMIAs before the announcement. What will happen now?<\/strong><br>If your business is in a census metropolitan area with a 6% or higher unemployment rate, the government will not process your LMIA application. The LMIA fees are only due once they are processed and as such, you won\u2019t be charged.<\/p>\n\n\n\n<p><strong>I currently have more than 10% TFWs in my workforce. Do I need to terminate their employment immediately?<\/strong><br>No, you do not need to terminate their employment immediately. TFWs accepted before the announcement can continue working until the end of their approved employment period. However, you will not be able to hire additional TFWs until your total workforce falls below the 10% cap.<\/p>\n\n\n\n<p><strong>What is Restaurants Canada doing in response to these changes?<\/strong><br>We are actively engaging with government, including meetings with the Prime Minister\u2019s Office, Ministers, and Members of Parliament, and advocating for some exemptions to these measures particularly in rural, remote, and tourist areas that face chronic labor shortages.<\/p>\n\n\n\n<p>Additionally, we are working with the government to identify alternative streams for our industry, specifically, a government funded matching and training program for newcomers to help our industry fill the current 72,000 job vacancies.<\/p>\n\n\n\n<p>In the meantime, operators are encouraged to look for existing alternate streams. For help you can access Restaurants Canada\u2019s <a href=\"https:\/\/www.restaurantscanada.org\/toolkit\/recruiting-international-workers-toolkit\/\">Recruiting International Workers toolkit<\/a>.<\/p>\n\n\n\n<p><strong>Are more changes coming<\/strong>?<\/p>\n\n\n\n<p>The Minister has stated that within the next 90 days, further review will be undertaken of the Program, which could result in a refusal to process other LMIA applications, including for rural areas (i.e. possibility of extending to some economic regions).<\/p>\n\n\n\n<p><strong>Restaurants Canada will continue to advocate and communicate with you, as the situation develops.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Modifications au Programme des travailleurs \u00e9trangers temporaires \u2013 FAQ<\/strong><\/p>\n\n\n\n<p><strong>Suis-je concern\u00e9 par ces nouvelles mesures ?<\/strong><br>Oui, si vous \u00eates dans le secteur de la restauration et que vous utilisez le Programme des travailleurs \u00e9trangers temporaires (TET), vous serez affect\u00e9 par les deux mesures suivantes :<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Limite sur le pourcentage de travailleurs \u00e9trangers temporaires :<\/strong> Les TET ne peuvent constituer plus de 10 % de votre main-d&rsquo;\u0153uvre totale.<\/li>\n\n\n\n<li><strong>R\u00e9duction de la dur\u00e9e maximale d\u2019emploi :<\/strong> La dur\u00e9e maximale d&#8217;emploi pour un TET est r\u00e9duite de 2 ans \u00e0 1 an.<\/li>\n<\/ol>\n\n\n\n<p>De plus, si votre entreprise se situe dans une r\u00e9gion m\u00e9tropolitaine de recensement o\u00f9 le taux de ch\u00f4mage est de 6 % ou plus, le gouvernement du Canada ne traitera pas vos \u00e9valuations de l&rsquo;impact sur le march\u00e9 du travail (EIMT).<\/p>\n\n\n\n<p><strong>Comment puis-je savoir si je suis dans une r\u00e9gion m\u00e9tropolitaine de recensement avec un taux de ch\u00f4mage de 6 % ou plus ?<\/strong><br>Vous pouvez v\u00e9rifier cette information <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/daily-quotidien\/240510\/t007a-fra.htm\">ici<\/a>.<\/p>\n\n\n\n<p><strong>Ces mesures s\u2019appliquent-elles aux \u00e9tudiants internationaux ?<\/strong><br>Non, ces mesures ne concernent que les travailleurs \u00e9trangers temporaires embauch\u00e9s via une EIMT.<\/p>\n\n\n\n<p><strong>J&rsquo;ai soumis des EIMT avant l&rsquo;annonce. Qu&rsquo;advient-il maintenant ?<\/strong><br>Si votre entreprise est dans une r\u00e9gion m\u00e9tropolitaine de recensement avec un taux de ch\u00f4mage de 6 % ou plus, le gouvernement ne traitera pas votre demande d\u2019EIMT. Les frais de traitement des demandes d\u2019EIMT ne sont dus qu\u2019apr\u00e8s leur traitement, alors vous n\u2019aurez pas \u00e0 d\u00e9bourser pour ceux-ci.<\/p>\n\n\n\n<p><strong>J\u2019ai actuellement plus de 10 % de TET dans ma main-d&rsquo;\u0153uvre. Dois-je les licencier imm\u00e9diatement ?<\/strong><br>Non, vous n&rsquo;avez pas besoin de les licencier imm\u00e9diatement. Les TET accept\u00e9s avant l&rsquo;annonce peuvent continuer \u00e0 travailler jusqu&rsquo;\u00e0 la fin de leur p\u00e9riode d&#8217;emploi approuv\u00e9e.
